The Health Information Technology for Economic and Clinical Health Act (HITECH Act) is part of the American Recovery and Reinvestment Act of 2009 (ARRA), which was signed by President Barack Obama on February 17, 2009. ARRA includes approximately $20 billion allocated to health information technology (IT) projects, including the investment in health IT infrastructure and the provision of incentives through Medicare and Medicaid reimbursement to assist physicians and hospitals in acquiring electronic health record (EHR) technology. In addition, ARRA has modified the Health Insurance Portability and Accountability Act of 1996 (HIPAA), by incorporating more robust privacy and security provisions that will impact the way health care providers deliver care to patients. ARRA extends HIPAA to business associates, requires notice to patients in the event of a security breach, broadens the scope of accounting for disclosures involving EHRs and restricts the sale of PHI. This program will discuss the sweeping impact that the modifications to HIPAA will have on the health care industry and will discuss potential sources of funding for Health IT initiatives.
Program Highlights:
- Providers will learn what financial incentives are available and when will they first be available. In addition, providers will learn how to satisfy “meaningful use” of a certified EHR to be eligible for Medicare and Medicaid funding incentives.
- Explain the changes to HIPAA, including the expansion of certain provisions to business associates and how it impacts covered entities and business associates.
- Describe the proposed security breach notification requirements under ARRA and how covered entities and business associates can address those requirements.
- Clarify the changes to the marketing and fundraising provisions of HIPAA and what it means for covered entities.
- Break down the restrictions on the sale of PHI and how this will impact data collection and warehouses and other compilations of data such as tissue repositories.
